Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern your use of the Nesiha mobile app (Android application ID nesiha.app), the Nesiha website, and related services (together, the “Service”) operated by Nesiha App (“Nesiha”, “we”, “our”, “us”).

By downloading, accessing, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you downloaded the app from the Apple App Store, Google Play’s terms also apply to that store’s distribution. Nothing in these Terms overrides mandatory consumer rights in your country.

2. Eligibility

You must be at least 13 years old, and old enough in your country to have a Google account and enter a contract, to create a Nesiha account. Where local law requires a higher age without parental consent, that higher age applies. The Service is not directed at children under 13 and is not a kids’ app.

You are responsible for compliance with local law where you use the app.

3. The Service

Nesiha is a free Islamic learning app. Features include, without limitation:

• Holy Quran (including Mushaf reader and bookmarks), translations, Hadith, duas, books, audio, and video from our library
• Search, downloads / offline cache, and account-linked favourites
• Prayer times, optional Adhan full-screen alarms with sound, Qibla compass, and Masjid Finder
• Dhikr, Asma ul Husna, Hijri calendar, and educational guides (such as Hajj, Umrah, fasting, zakat)

Signing in with Google is required to use the app. The Service is provided free of charge. There are no in-app purchases and no subscriptions in the current app. We may add, change, suspend, or remove features, content, or availability (including maintenance windows) at any time.

4. Accounts

You sign in with Google (email and profile). You must provide accurate onboarding information (including name and country) and keep your Google account secure. You are responsible for activity under your Nesiha account.

We may suspend or terminate an account that violates these Terms, appears fraudulent, or creates risk for other users or the Service.

You may delete your account at any time from Profile in the app, or request deletion at nesiha.app/delete-account without signing in on the website.

5. Acceptable use

You agree not to:

• Use the Service for anything unlawful, harmful, or deceptive
• Scrape, bulk-download, or commercially redistribute library content except as we expressly allow
• Attempt to disrupt, probe, or reverse engineer the app or API except as permitted by law
• Impersonate others, abuse support channels, or submit malware or spam
• Circumvent technical limits, authentication, or content protections
• Use the Service to provide professional religious rulings as if they came from Nesiha
• Misrepresent Nesiha content as a fatwa, as the Quran itself when it is a translation or guide, or as AI-generated scholarship

6. Religious and educational content — important disclaimer

Nesiha is a learning tool. It is not a mufti, imam, or scholar, and it does not issue fatwas.

• Quran text, translations, books, lectures, and guides are for personal education.
• They do not replace qualified scholarship, a local masjid, or your own verification of sources.
• Prayer times depend on location, timezone / network clock when available, and a calculation method (currently Muslim World League). Treat them as estimates and confirm locally if needed. A wrong phone clock, denied location, or aggressive battery settings can affect accuracy and Adhan delivery.
• Qibla uses GPS and the device compass (and related motion sensors where available). Magnetic interference, poor GPS, or denied permissions can make it inaccurate.
• Adhan alerts are optional. If you enable them, you authorize local exact alarms, notification sound, vibration, and (where the OS allows) a full-screen Adhan UI that may wake the screen at prayer time. You can turn Adhan off at any time in Adhan Settings. We are not responsible for missed prayers if the OS delays or blocks alarms (for example denied exact-alarm / full-screen permission, Do Not Disturb, or OEM battery savers).
• Zakat, Hajj, Umrah, and fasting guides are general information, not personalized rulings.
• We strive for authentic sources but do not guarantee completeness, translation quality, or error-free content.

7. Permissions you grant on your device

Some features need system permissions. Location, camera, notifications, photos, vibration, and (on Android) exact alarms and full-screen intent are used only as described in the Privacy Policy. You can refuse them; related features may not work. Library browsing does not require location or camera. Adhan stays off until you enable it.

Masjid Finder may open Google Maps outside the app. Donate and some legal pages may open in an in-app browser. Those sites have their own terms.

Audio may continue in the background. When Adhan is enabled, alerts may fire when the app is closed, may play Adhan audio once per prayer, may open a full-screen alarm UI, and may be rescheduled after the device reboots. The app may briefly contact public HTTPS endpoints only to read network time so Adhan is not thrown off by a wrong device clock (see Privacy Policy). You can disable Adhan in Adhan Settings.

8. Intellectual property

The Nesiha name, logos, app design, and original software are owned by Nesiha or its licensors. You receive a limited, revocable, non-exclusive, non-transferable license to use the app for personal, non-commercial educational use.

Quranic text, translations, books, audio, video, and similar materials remain the property of their authors, publishers, reciters, and rights holders. They are made available through Nesiha for personal educational use. You may not copy the library for commercial redistribution or present it as your own.

If you believe content infringes your rights, contact us with a URL or in-app location, a description of the work, and your contact details. See also our Legal Notice.

9. Your content (feedback and messages)

If you send feedback or a contact message, you grant Nesiha a worldwide, royalty-free license to use that content to operate and improve the Service and to reply to you. Do not send confidential information you do not want us to store. Do not submit content that is illegal or that you do not have the right to send.

10. Third-party services

The Service depends on third parties, including Google (Sign-In, Play, Maps, Fonts), Supabase (authentication), our hosting providers, and — when Adhan/prayer clock sync runs — public HTTPS hosts used only to read an HTTP Date header. Their terms and privacy policies apply to their processing. Nesiha is not responsible for third-party sites or apps you open from Nesiha, including Google Maps, Buy Me a Coffee, and the system share sheet.

11. Donations, purchases, and ads

The current app has no in-app purchases, no subscriptions, and no ads. Donations, if offered, are processed by a third-party provider (currently Buy Me a Coffee). They are voluntary, not required to use core features, and are not a purchase of in-app digital content. We do not receive your card details.

12. App Store and Google Play

If you obtained the app from Apple, you acknowledge that these Terms are between you and Nesiha, not Apple. Apple has no obligation to provide maintenance or support. To the extent allowed by law, Apple has no warranty obligation; any claims relating to the app (product liability, legal or regulatory, consumer protection, intellectual property) are between you and Nesiha, not Apple. Apple and Apple’s subsidiaries are third-party beneficiaries of this section and may enforce it. You represent that you are not in a country subject to a US government embargo and are not on a US government prohibited or restricted-party list, as required by Apple’s standard licensed-application terms.

If you obtained the app from Google Play, Google’s Play Terms of Service also apply to your download from Play.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that prayer times, Adhan delivery, Qibla, network clock sync, search results, translations, or other content will be accurate, uninterrupted, or error-free.

14. Limitation of liability

To the maximum extent permitted by law, Nesiha and its team are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, missed prayers, delayed or blocked Adhan alarms, reliance on religious or scheduling information in the app, or third-party / OS restrictions on notifications and alarms.

To the extent liability cannot be excluded, our total liability for claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim (currently typically zero) or (b) USD 50.

Some jurisdictions do not allow certain limitations. In those places, the limits apply only to the extent allowed.

15. Termination

You may stop using the Service and delete your account at any time. We may stop providing the Service or close accounts as described above. Sections that should survive (including intellectual property, disclaimers, and liability limits) continue after termination.

16. Changes to these Terms

We may update these Terms. The date at the top will change. Continued use after an update constitutes acceptance. If you do not agree, stop using the Service and delete your account.
